Drew Peterson files appeal, cites ineffective counsel

On Friday, Drew Peterson asked a judge to throw out his conviction for the murder of third wife Kathleen Savio or grant him a new trial.

Peterson's re-formed legal team presented his appeal Friday to Will County Judge Edward Burmilla.

The appeal cites ineffective legal counsel at his trial. Former lead attorney Joel Brodsky is accused of incompetence and could be called to testify.

Brodsky withdrew as Peterson's lead attorney last month in the midst of infighting within the defense team. He was replaced by David Peilet. Attorney Steve Greenberg also remains on Peterson's defense team.

Peterson's sentencing date was originally set for January 10. The judge postponed it indefinitely to give both sides time to file new motions.
