Alabama Legislature Sue Schmitz

The federal judge in state Rep. Sue Schmitz's fraud trial has urged deadlocked jurors to keep working for a unanimous verdict and is reminding them of their obligations.

U.S. District Judge David Proctor spoke to the panel Monday and
gave them additional instructions as they began their fourth day of
deliberations.

Jurors sent Proctor two notes last week saying they were deadlocked.

The judge said that in light of notes from jury members, he is to be told immediately if any members fail or refuse to participate in the deliberations.


He told them the case would be tried again if they don't reach a verdict.

Schmitz, a Democrat from Toney in north Alabama, is accused of getting $177,000 from a "no work" job in the two-year college system.
