The children building a tree-house encountered a man that was outta his tree on Monday.

An employee of a St. Augustine convenience store called deputies to remove a man that was passed out behind the business.

When the deputy arrived, several young children who had been building a tree-house next to the store told the deputy that a man, later identified as Arthur Lee Cushman, had been yelling and cursing at them, according to an arrest affidavit from the St. Johns County Sheriff's Office.

After the deputy tried several times to wake up the 41-year-old man, who was passed out with a half-eaten pork chop in his hand, the man began to shout profanities, the affidavit states.

The deputy then told the man to watch his language in front of the children.

Instead, Cushman let out the F-bomb.

Now Cushman is up a tree: He was charged with disorderly intoxication and taken to jail.
